Terms of Service

1. Introduction and Acceptance

Welcome to Jambox ("Service", "we", "us", "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Jambox regarding your use of our collaborative music queue platform available at https://jambox.dev, whether accessed through our web application, mobile application, API, or self-hosted instance.

By accessing, registering, or using Jambox in any form, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to https://jambox.dev/terms. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of such changes.

2. Service Description

Jambox is a collaborative, real-time music queueing application that enables multiple users to add and vote on songs for a shared listening experience.

2.1 Core Features

• Collaborative Queue Management: Add and manage songs from integrated music platforms
• Song Voting System: Upvote or downvote songs to influence playback order
• Moderation System: Administrative controls for content and user management
• QR Code Access: Easy sharing and guest invitation via QR codes
• Admin Dashboard: Password-protected management panel
• Real-time Updates: Live synchronization across all connected users
• Multi-language Support: Interface available in multiple languages

2.2 Access Models

• Freemium Model: Limited access with optional premium features
• Subscription Model: Recurring billing for enhanced features
• One-Time Purchase: Single payment for lifetime or time-limited access
• Time Tokens: User-controlled access tokens providing time-limited service access
• Self-Hosted Instance: Users may host Jambox on their own infrastructure

2.3 Music Integration

Jambox integrates with third-party music streaming platforms including but not limited to Spotify and YouTube to provide music sources. You must comply with the terms of service of each integrated platform.

3. Eligibility and User Accounts

3.1 Eligibility Requirements

• You must be at least 13 years of age (or the legal age of digital consent in your jurisdiction)
• Users under 18 may require parental/guardian consent
• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials

3.2 Account Creation and Responsibility

• Account creation is subject to our acceptance
• You are solely responsible for all activities conducted under your account
• You must notify us immediately of any unauthorized access or security breaches
• We reserve the right to suspend or terminate accounts that violate these Terms

3.3 Multiple Accounts

Users may not create multiple accounts to circumvent limitations, engage in abusive behavior, or manipulate voting systems. Violation may result in immediate account suspension.

4. Acceptable Use Policy

4.1 Prohibited Conduct

You agree NOT to:

• Use the Service for illegal purposes or in violation of applicable laws
• Upload, share, or promote copyrighted content without proper authorization
• Engage in harassment, bullying, hate speech, or discrimination
• Attempt to manipulate or hack the Service or underlying systems
• Use bots, scripts, or automated tools to artificially inflate votes or bypass limitations
• Share explicit, pornographic, or extremely violent content
• Spam, phish, or engage in social engineering
• Circumvent security measures or access control systems
• Reverse-engineer, decompile, or attempt to derive the source code
• Use the Service to develop competing products without authorization

4.2 Content Moderation

We may remove, restrict, or filter content that violates these Terms. We reserve the right to issue warnings, temporarily suspend access, permanently ban users, or report illegal activity to appropriate authorities.

5. Copyright and Intellectual Property

5.1 User-Generated Content

Users retain ownership of their own content (playlists, votes, comments, configurations). By using the Service, you grant Jambox a non-exclusive, royalty-free license to store, display, and transmit your content as necessary to operate the Service. You are solely responsible for ensuring your use of music content complies with applicable copyright laws.

5.2 Jambox Intellectual Property

All Jambox software, design, branding, and documentation is protected by copyright and intellectual property laws. Users may not use Jambox materials without explicit written permission except as permitted by these Terms.

6. Payment Terms and Pricing

6.1 Pricing and Billing

All prices are displayed in EUR or your local currency as applicable. Prices may change with notice; changes will not apply to active subscriptions during the current billing period. You are responsible for all taxes associated with your purchase (unless otherwise required by law).

6.2 Subscription Model

Subscriptions automatically renew at the end of each billing cycle. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

6.3 One-Time Purchases

One-time purchases grant access for the specified duration or permanently (as described at purchase). No refunds are available except where required by law.

6.4 Time Tokens

Tokens are account-specific and non-transferable. Unused tokens do not expire unless otherwise stated.

6.5 Refund Policy

• Refunds for subscriptions must be requested within 14 days of charge
• Refunds for one-time purchases may be requested within 14 days of purchase
• Self-hosted instances are non-refundable
• Refunds will be issued using the original payment method

7. Self-Hosted Instances

Users may host Jambox on their own infrastructure. Self-hosted instances are subject to separate licensing terms, not covered by Jambox support or SLAs, and solely the user's responsibility for security, updates, and compliance. Jambox provides self-hosted instances "as-is" without warranty.

8. Data Privacy and Protection

8.1 Data Collection Policy

Jambox is committed to minimizing data collection. We only collect and retain account information (username, email, hashed password), usage data (queue history, voting records, access logs), and technical data (device information, IP addresses for security).

We do not collect personal browsing history outside Jambox, location data (unless explicitly provided), biometric information, or financial information beyond transaction records.

8.2 Data Deletion Upon Account Termination

All personal data is permanently deleted within 30 days of account deletion. Queue history and voting records are anonymized or deleted. Users may request immediate deletion via email to compliance@jambox.dev.

8.3 EU Data Protection Compliance

Jambox operates from Germany and complies with EU GDPR, EDPB guidelines, and national data protection laws. Data subjects have rights including access, rectification, erasure, and portability. Data protection inquiries: compliance@jambox.dev.

8.4 Data Retention

Account data is retained for the duration of the account relationship. Transaction records are retained for legal and tax compliance (typically 7–10 years). Usage logs are retained for 90 days unless longer retention is legally required.

9. Third-Party Music Integrations

Jambox integrates with third-party music streaming services (Spotify, YouTube, etc.). By using these integrations, you agree to comply with the terms of service of each platform. Jambox is not responsible for content provided by these platforms and does not endorse or guarantee the legality of any music source.

10. Voting and Moderation System

The voting system is intended to democratically influence queue order. Users may only vote once per song. Admins may disable voting for specific users or songs. Jambox reserves the right to invalidate votes obtained through manipulation.

11. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. JAMBOX DISCLAIMS ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, AND DOES NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JAMBOX'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM, OR €50, WHICHEVER IS GREATER. IN NO EVENT SHALL JAMBOX BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

13. Indemnification

You agree to indemnify and hold harmless Jambox from any third-party claims arising from your use of the Service, violation of these Terms, use of content in violation of copyright laws, or violation of applicable laws.

14. Dispute Resolution and Governing Law

These Terms are governed by the laws of Germany. Disputes shall be subject to the exclusive jurisdiction of courts in Berlin, Germany. Before legal action, parties agree to attempt resolution through good-faith negotiation, then escalation to senior management if unresolved within 14 days.

15. Termination

Users may terminate their account at any time via account settings or by emailing support@jambox.dev. Jambox may terminate accounts for violations, illegal activity, extended inactivity, or technical reasons. Upon termination, all access rights are immediately revoked and data is deleted according to Section 8.2.
